Ok, so after some study, these are the some of the quick points I am going to add to the topic of Islam allowing Muslim men to take female prisoners of war captives and have sexual relationships with them.
A point that has already been bought up, but it is a heavy point so I am going to utilize it. The argument is who decides what is morally wrong. God, or human reasoning? I will expound more on this point soon in a properly drafted apologetic paper, in sha Allah. Islam is an ideal religion. It is not that man is the owner of women as some would like to put it. No, man is responsible for looking after women whether it is his wife, daughters, etc. Even his mother if his father dies – he becomes “the man of the house” – It is his duty to provide the needs of the women, and look after them.When a man gets married to a woman, it is the shifting of responsibility from the father to the husband of the women. He becomes her caretaker, protector, provider. The marriage contract is valid by two willing spouses who desire to marry each other and sealed with witnesses. This is what it takes for a nikah to be valid.
Allah has revealed that it is halal to have sexual intercourse with your legal wife and female prisoners of war who have been captured. The reason being that no contract is needed is an important question to this whole topic. How a man is allowed to have sexual relations with a female prisoner of war “outside” of marriage!
Well the fact is:A. that Allah has revealed it is permissible B. The sunnah is to place a chadar over the woman prisoner of war to signify to the others that the woman is now under your care and is halal for you but not for anybody else. when this is done you do not need witnesses.But why no nikah, marriage contract?
Well first of, let me just say that war is an unwanted necessity, that is how it is viewed within Islam. Islam does not promote war, but as it is an ideal religion, it deals with every circumstance of reality.
Now imagine you are a soldier in battle. The man you have just killed was a father, or a husband, or even a son. You have just taken their protector, their provider, their caretaker. It is only ideal and just that the responsibility is transferred from the man you have just killed to you. You must bear the responsibility of looking after this family. therefore no “marriage contract” is needed, because the transfer of responsibility has already happened. All one has to do at the end of the battle is place the chaddar over the women and take them into your care. That is the marriage confirmed, when the tranferal of responsability passes on from one man to the other.
Ok, but what about sexual relationships? Does this mean you can rape and force them to have sex against their will?
No. There is not one example from the Qur’an, mass volumes of hadeeth, or the prophetic biography that even suggest you can rape or force a woman to have sex with you against their own will, and the account that Islamophobes quote about the Jewish woman Saffiyah, radiy Allahu anhaa, is twisted to make insinuations that the Prophet, sal Allahu ‘alayhi wasallam,
1. Killed Safiyyah’s husband and had his companion march Safiyyah and another female captive past the dead body of their husbands
2. Take Saffiyah for himself because of her immense beauty
3.Take of the battle-field and rape against her will just after her husband was killed
These filthy insinuations are far from the truth, and here is why.
I will not answer the above in their numbered order. Bur according to a time scale.Firstly the context of the battle. It was not that the Prophet, sal Allahu ‘alayhi wasallam hated Jews and went to war with them all. When the people of Yathrib gave the state authority to the Prophet, sal Allahu ‘alayhi wasallam, there were three Jewish tribes. The Prophet, sal Allahu ‘alayhi wasallam, entered into a treaty with them. This treaty stipulated they would all keep their religion and be allowed to worship freely, and that they would all protect the state if it was attacked by outsiders.
Well, one of those tribes was the banu Nadir. They comitted treason against the Prophet, sal Allahu ‘alayhi wasallam, and treason, according to their own Torah, was punishable by death. The Prophet, sal allahu ‘alayhi wasallam, made an exception and allowed them to leave Yathrib [now known as Madinah] and settle at a location called Khyber.Despite this, they still conspired against the Prophet, sal Allahu ‘alayhi wasallam, so the Prophet, sal Allahu ‘alayhi wasalla, went to see them and try and smooth things out and enter into another peace treaty. Yet again, they conspired to assinate the Prophet, sal Allahu ‘alayhi wasallam, but Allah made their attempt futile by informing the Prophet, sal Allahu ‘alayhi wasallam, what they were about to do. The Prophet, sal Allahu ‘alayhi wasallam, escaped just in time.
Now, you can imagine if this was the president of the United States visiting ‘Iraq, or some other location, for peace talks and that government tried to assassinate him. Of course, they would have to go to war. Otherwise, the Madinain state [i.e. Madinah] and it’s leadership would be constantly under threat. They has to go to war. So they did.
The leader of the Jews of Khyber, the Banu Nadir was Safiyyah’s father. He was killed in the battle, leaving Safiyyah with no protector, provider.The companions of the Prophet, radiy Allahu ‘anhum, informed the Prophet, sal Allahu ‘alayhi wasallam, about the female captives, and especially the beauty of Safiyyah – as stated in the hadeeth – so the Prophet, sal Allahu ‘alayhi wasallam, went to see them.
He started to approach a woman to pick her to take into his care, but she started screaming. The Prophet, sal allahu ‘alayhi wasallam, told the companions to take her away. This proves two things.
1. That Safiyyah was not his first choice, despite being told about her immense beauty. The Prophet, sal Allahu ‘alayhi wasallam, never picked any of his wives of female captives due to their beauty.
2. He would not take the woman. the fact he left her alone proves that he did not force her against her will. So the whole rape claim falls to the ground right here.
He then chose Safiyyah, placed his chaddar around her and escorted her to his camel. the hadeeth even states that she followed behind him, indicating she came willfully.
When we look to this hadeeth further, we also see an act of manly chavelry on the part of the Prophet, sal allahu ‘alayhi wasallam. when Safiyyah was getting on the camel. the Prophet’ sal Allahu ‘alayhi wasallam, got down on one knee, allowing the feet of Safiyyah to tread on his blessed knee to mount the Camel. SubhanAllah ! What a man, sal Allahu ‘alayhi wasallam. What honor he gave to Safiyyah. Had she came unwillingly, this would have been her perfect chance to kick the Prophet, sal Allahu ‘alayhi wasallam, in the face and escape on his camel!
Moreover, the texts of the seerah mention, that when the Prophet, sal Allahu ‘alayhi wasallam, took Safiyyah as his, she had a bruised eye. He asked her why her eye was bruised, and she informed the Prophet, sal Allahu ‘alayhi wasallam, that she had a dream about the moon falling into her lap. She narrated this dream to her father or husband [there is some discrepancy as to which] beat her and accused her of desiring the leader of Yathrib, i.e. the Prophet, sal Allahu ‘alayhi wasallam. Keep in mind the domestic violence on Safiyyah happened before the battle.
The Islamophobes conveniently skip this fact when mentioning Safiyyah because it proves that she went with the Prophet, sal Allahu ‘alayhi wasallam willingly.
Also, the Islamophobes try to insinuate that the Prophet, sal Allahu ‘alayhi wasallam, had sex with Safiyyah straight after taking her from the battlefield after her husband and father were both killed. They attempt to portray the Prophet, sal Allahu ‘alayhi wasallam, as an unmerciful caveman with a club, who kills the men, knocks the woman on the head with his club, and drags her off to his cave to cohabit with her against her will.
This is what they would like you to believe as they throw emotional appeals about Safiyyah’s trauma of losing her husband and father in battle , and then being raped in the same day. Do these people not read the texts? Yes of course they do, and what they did not tell you is that the Prophet, sal Allahu ‘alayhi wasallam, waited until her next menstruation cycle was finished before he consummated the marriage. This could have been a whole month, or even more.
Another fact that Islamaphobes like to hide is that the Prophet, Sal Allahu ‘alayhi wasallam, condemned Bilal for marching the female prisoners of war past their dead husbands, fathers and sons. He questioned Bilal ” Do you have any compassion, why did you have to march them past their dead?” his demonstrates the compassion of the Prophet, sal Allahu ‘alayhi wasallam, and puts their emotional pleas, and false claims to bed.
Furthermore, those who claim that he violated female captives against their will, let us remind them of another female captive that the Prophet, sal Allahu ‘alayhi wasallam, had responsability over. He invited her to Islam repeatedly, but she refused and wanted to remain as a Jew. The Prophet, sal Allahu ‘alayhi wasallam, left her alone in her decision and allowed her religious freedom.This should be enough to answer the filthy claims of the Islamophobes.
